Clients often ask me: “how much does an absolute divorce cost?” Although there may be other issues associated with a separation and divorce, such as child support, child custody, alimony, etc., the divorce process itself can occur independent of these other issues.

The cost for filing an Absolute Divorce in North Carolina is $225.00, which is payable to the Clerk of Court in the county in which you are filing. In addition to this initial filing fee, you may also choose to resume your maiden name, which is an additional $10.00. Finally, you must serve your spouse with the filed divorce documents. Most commonly, the person filing for divorce will choose to serve their spouse by Sheriff, which costs $30.00, payable to the County Sheriff’s office. Be aware that the county in which you file may have local rules which require the payment of additional miscellaneous expenses.

It is important to note that matters related to Equitable Distribution and Alimony need to be pending prior to the entry of an Order for Absolute Divorce. If a Order is entered for Divorce prior to the filing of a motion of Equitable Distribution and/or Alimony your rights could be cut off.
